AN ORDINANCE AMENDING SECTION 3 OF MUNICIPAL ORDINANCE NO. 07, SERIES OF 2004, RE: AN ORDINANCE REGULATING THE OPERATIONS OF KARAOKE/VIDEOKE JOINTS IN THE MUNICIPALITY OF MARIBOJOC, BOHOL.

WHEREAS, the local officials of the Municipality of Maribojoc, Bohol have, of late, been recipient to a lot of complaints coming from both the heeled and the unshod sectors of the community, regarding the inconsiderate operation of video joints even up to the unholy hours of near midnight;

WHEREAS, one of our declared policies is to promote the general welfare of our community and its people;

WHEREAS, based on such complaints, it is imperative for us to exercise our inherent and plenary powers to regulate economic enterprises;

WHEREAS, in the exercise of such rights, we may restraint set in the form of a policy, other regulatory rights that are harmful to the comfort, safety and welfare of society;

WHEREFORE, premises considered , be it ordained by the Sangguniang Bayan of Maribojoc, Bohol, that:

SECTION 1 – REGULATION. – Any person, corporation or partnership who shall engage in the
operation, maintenance and establish must of commercial video/karaoke joint shall comply the requirement and must abide to be governed by the following terms and conditions:

A.) Secure a Mayor’s/Business Permit
B.) Secure a Sanitary Permit
C.) Operation of the establishment shall only be on the following schedule:

DAYS TIME
1. Sundays – Thursday 9:00 A.M. to 9:00 P.M.
2. Fridays, Saturdays & days before
A holiday 9:00 A.M. to 10:00 P.M.

SECTION 2 – PENAL PROVISION ; Any person, corporation or partnership that violates any
provision of this ordinance shall be fined with:

a.) 1st offense – P 500.00 or a community service of five ( 5 ) days
b.) 2nd offense – P1,000.00 or a community service of ten ( 10 ) days
c.) 3rd offense – P 2,000.00 or a community service of twenty (20) days
PLUS revocation of permit/closure of establishment

Community service may be rendered in the municipality-owned establishments of the LGU such as, but not limited to, the municipal buildings and plaza, public market, municipal cemetery, municipal nursery, waterworks pumping stations and their surroundings or as may be recommended by the local Chief Executive.

SECTION 3. – REPEALING CLAUSE: Any ordinance or provisions of such ordinance(s)
inconsistent to the provision(s) of this ordinance is deemed repealed ad/or amended.

SECTION 4 – EFFECTIVITY. – This ordinance shall take effect upon its approval.

Let copies of this ordinance be furnished the Chief of Police, all Punong Barangay and al Chief Tanod for their information, guidance ad implementation.
