AN ORDINANCE ESTABLISHING A SYSTEM OF PROCESSING AND APPROVAL OF APPLICATION FOR SUBDIVISION OF LOTS AND IMPOSING FEES THEREOF.

PRELIMINARY NOTES
WHEREAS, there is a need for a legislative approval of subdivision of lots pursuant to Article III, Section 447, 2,(x) of R.A. 7160, otherwise known as the Local Government Code of 1991;
WHEREAS, such imprimatur is also required by the Land Registration Authority and other government agencies;
WHEREAS, due to its ministerial nature and to facilitate the fast processing of application for approval of lot subdivision, it is imperative to formulate and system and methods to attain this end;
WHEREAS, in the light of our cadastral survey which hopefully would lead to the titling of lands and subdivision of lots among heirs, a system of processing and approval of subdivision of lots must be established to ease and facilitate such;
WHEREFORE, be it ordained by the Sangguniang Bayan in their session duly assembled:
SECTION 1: Title: This ordinance shall be called as “The Lot Subdivision Ordinance of the
Municipality of Maribojoc, Bohol.
SECTION 2: Scope: This ordinance covers all kinds of subdivision of land or lots within the
jurisdiction of Maribojoc, Bohol.
SECTION 3: Definition of Terms: When used in this ordinance, the following terms shall
mean:
a. Lot – a parcel of land
b. Application – the act applying, a petition, request
c. Application papers- include the duly accomplished application form
together with the pertinent supporting documents.
d. Application letter – letter of application for the approval of subdivision
of lot
e. Subdivision of lot – the act or process of dividing a single parcel of land
into two or more smaller lots.
SECTION 4: Application:
(a) All application for approval of lot subdivision shall be filed in writing with the Secretary to the Sangguniang Bayan and shall consist of the following:
1. The duly accomplished form;
2. A certified true copy of the subdivision plan duly signed by a licensed Geodetic Engineer.
3. A certified true copy of the original or transfer certificate of title of the lot being subdivided.
4. Tax Clearance Certificate from the Municipal Treasurer on the lot being subdivided.
5. Clearance from the Municipal Engineer that the lot being subdivided is not covered by any existing or proposed government infrastructure project and,
6. Certified copies of other pertinent documents (deed of sale or donation and etc.
(b) The Secretary to the Sangguniang Bayan shall receive the application papers who shall then transmit these to the chairman of the Committee on Cadastral Survey or referral during the SB session
SECTION 5: Approval.
a. The Sangguniang Bayan, thru the Presiding Officer shall approve/deny such application depending upon the recommendation of the committee on Cadastral Survey to which the application for subdivision was referred to;
SECTION 6: Fees. The following fees shall be collected from the applicant on all approved
applications for lot subdivisions.

a. less than 500 sq. m. ——– P 50.00
b. 500 sq. m. or more but less than 2,000 sq. m. ——– P 100.00
c. 2,000 sq. m. or more but less 4,000 sq. m. ——– P 150.00
d. 4,000 sq. m. or more but less 6,000 sq. m. ——– P 200.00
e. 6,000 sq. m. or more but less than 8,000 sq. m. ——– P 250.00
f. 8,000 sq. m. or more but less than 10,000 sq. m. ——— P 300.00
g. 10, 000 sq. m. or more but less than 12,000 sq. m.——- P 350.00
h. 12,000 sq. m. or more but less than 14,000 sq. m.——– P 400.00
i. 14,000 sq. m. or more but less than 20,000 sq. m. ——- P 500.00
j. 20,000 sq. m. or more but less than 30,000 sq. m. ——- P 700.00
k. 30,000 sq. m. or more ——— P1,000.00
SECTION 7: Enforcement.- Final approval shall be made only after the owner or applicant
shall have paid the corresponding fees as provided for in Section 6 on this ordinance and such other applicable fees provided for in the Revenue Code of Maribojoc.
SECTION 8: Payment of Fees.- The fees for sub-division of lot shall be paid at the Municipal
Treasurer’s Office, Maribojoc, Bohol.
SECTION 9: Separability Clause.- Any provisions of existing ordinances, which are
inconsistent hereof, are hereby repealed, amended, or modified accordingly.
SECTION 10: Effectivity: This ordinance takes effect upon approval.
