AN ORDINANCE IMPOSING RENTAL FEE FOR THE USE OF THE MULTI-PURPOSE COURT OWNED, OPERATED AND MAINTAINED BY THE LOCAL GOVERNMENT UNIT OF MARIBOJOC, BOHOL

WHEREAS, the Local Government Unit of Maribojoc owns, operates and maintain a multi-purpose court inside the Maribojoc Cultural and Sport Center (MCSC);

WHEREAS, this government facility needs maintenance for its operation and use;

WHEREAS, there are persons or group of persons who would like to avail of the use of the multi-purpose court inside the MCSC;

WHEREFORE, be it resolved by the Sangguniang Bayan of Maribojoc, Bohol, that:

SECTION 1: Rental Fee.-

There shall be a rental fee to be imposed for the use of the multi-purpose court inside the MCSC, as follows:

1. For different Ballgames

a. Basketball – P100.00 per hour
b. Volleyball – P 50.00 “
c. Badminton – P 50.00 “
d. Lawn Tennis – P 75.00 “
e. Table Tennis – P 50.00 “

2. For Physical Fitness Exercise/
Cultural Songs/Dance Practice – P 50.00 per hour

Any fraction of an hour of use shall be determined base on the following:

1. 50% of the rental fee for the use of more than 15 minutes but not more than30 minutes.

2. 100% of the rental fee for the use of more than 30 minutes.

SECTION 2: Use of Multi-Purpose Court for Fund Raising.-

If the multi-purpose court is use for sport competition to generate funds, the rental fee shall be as per Section 1 of this ordinance plus the rental fee for th use of the MCSC as provided in Section 1. 1.2 of the Municipal Ordinance No. 8 series of 2005.

SECTION 3: Use of Electric Power Facility.-

When electric lightings, electronic score board, and other equipment that operate with the use of electric power is use, the electric consumption shall be determined and added to the rental fee as per section 1.b of Municipal Ordinance No. 2 Series of 1999.

SECTION 4: Availability of the Multi-Purpose Court.-

The multi-purpose court shall be available to the users from Monday thru Friday from 5 pm to 10 pm, except Thursday, when the multi-purpose court is reserve for the exclusive use of the officials and employees of the Local Government Unit of Maribojoc.

If circumstance requires that the game or the use of the multi-purpose court has to be extended beyond the required schedule or when the users choose to use the multi-purpose court on Saturday and Sunday, or during holiday, the users in addition to the rental fee shall pay an amount of Ph25.00 per hour to cover the overtime pay of the employee in-charge of the MCSC.

SECTION 5: Authority of the Local Executive.-

The Local Chief Executive is hereby authorize to grant discount of not exceeding 50% of the total rental fee as per section 1 of this ordinances and section 1. a 2 of the Municipal Ordinance No. 8, Series of 2005, provided that the use of the multi-purpose court is for sport competition to generate funds, manage by the barangays or other government agencies or manage by person or group of persons whose aim is to promote sport in the Municipality of Maribojoc. Provided further, that the rental fee accumulated has exceed P3,000.00

If the user is a government agency, the Local Chief Executive is hereby authorized to grant the use of the MCSC and the multi-purpose court for free if the use is not for fund raising purposes.

The authority of the Local Chief Executive shall not apply to the electric consumption and overtime pay of the employee in-charge of the MCSC.

SECTION 6: Designation of MCSC Administrator.-

The Local Chief Executive shall designated an employee, regular or casual, who shall supervise the operation of the MCSC and multi-purpose court and likewise act as MCSC Administrator.

Duties and Responsibilities of the MCSC Administrator

1. Maintain the cleanliness of the MCSC and multi-purpose court at all times.

See to it that comfort rooms are clean and the multi-purpose court flooring is regularly mop.

2. Check equipment and other facilities inside the MCSC if they are in good working condition.

3. Keep the schedule of the users of the MCSC and multi-purpose court but in no case FIRST COME FIRST SERVE BASIS must be observed.

To be included in the schedule the user must show the copy of the Official Receipt to the MCSC Administrator as a proof that he has already made an advance payment.

4. Maintain custody of the equipment and other facilities inside the MCSC.

No equipment shall be taken out from the MCSC without the written permission and approval of the Local Chief Executive

5. Accept payment and issue temporary receipt during non-office hours.

Collection made must be remitted on the following working day to the Municipal Treasurer’s Office for issuance of Official Receipt. The collections must be supported with duplicate copy of the Temporary Receipts showing the details of the charges (ex. Computation of overtime, electric meter reading from the start to the end, etc.) to facilitate verification.

6. Keep the MCSC close if not in use.

7. Be at the vicinity of the MCSC when the MCSC or multi-purpose court is in use to answer complaints and needs of the users.

SECTION 7: Permission from the Local Chief Executive.-

Any person or group of persons who would want to use the MCSC and multi-purpose court should first secure permission from the Local Chief Executive before arranging payments to the Municipal Treasurer’s Office.

If for any reason a person or group of persons fail to secure permission from the Local Chief Executive then that person or group of persons shall have to wait for the person or group of persons who have secure permission from the Local Chief Executive to finish using the MCSC and multi-purpose court before they can avail of the use of the MCSC and multi-purpose court.

SECTION 8: Penalty.-

Any person or group of persons who violate the provisions of this ordinance shall be fined in the amount of P1,000.00 or an imprisonment of not less than one (1) week but not more than two (2) weeks or both fine and imprisonment, at the discretion of the court.

SECTION 9: Repealing Clause.-

Any provision of existing ordinances, inconsistent to the provisions of this ordinance, are deemed repealed.

SECTION 10: Effectivity.-

This ordinance shall take effect upon approval.
