AN ORDINANCE REQUIRING OWNERS, OPERATORS AND DRIVERS OF TRICYCLES AND MOTORCYCLES TO INSTALL SILENCERS OR ANY NOISEREDUCING DEVICE ON THEIR VEHICLES TO RID ANNOYING, UNPLEASANT, IRRITATING AND UNWELCOMED SOUNDS WITHIN THE JURISDICTION OF THE MUNICIPALITY OF MARIBOJOC, BOHOL.

WHEREAS, it has been observed that some of the tricycles and two (2) wheeled motorized vehicles are running/operating without the installation of the silencers;

WHEREAS, motorized vehicles without the silencers can emit irritating and unwelcomed sounds that can disturb the public especially during evenings;

WHEREAS, motorized vehicles without the silencers can create noise pollution that cause health hazard and stress that lead to various illness and even permanent loss of hearing;

WHEREFORE, be it resolved as it is hereby resolved by the Sangguniang Bayan in their session duly assembled;

BE IT ORDAINED by the Sangguniang Bayan of Maribojoc, Bohol that:

SECTION 1: Definition of Terms.-

a.) Tricycles – a (3) three wheeled motorized vehicles that can carry (2) two passengers excluding the driver both private and public use.

b.) Motorcycles – a two (2) wheeled motorized vehicles that can carry one (1) passenger excluding the driver both private and public use.

c.) Silencers – a mechanical noise – reducing device attached to the exhaust pipe/extension muffler of a motorized vehicles.

SECTION 2: Prohibition.-.

Owners, operators and drivers are not allowed to run/operate their three (3) and two (2) wheeled motorized vehicles without the installation of the silencer to suppress the noise of the engine at any time.

SECTION 3: The PNP, Barangay Officials and Barangay Tanods shall monitor any motorized vehicles running/operating within the jurisdiction of Municipality of Maribojoc, Bohol without the installation of silencers.

SECTION 4: Penalty.-

a.) 1st offense – P500.00 fine and confiscation of drivers license.

b.) 2nd offense – P1,000.00 fine and impounding of a tricycle or motorcycle.

c.) 3rd offense – P1,500.00 fine and impounding of a tricycle or motorcycle and cancellation of business to operate for public use motorized vehicles or upon the discretion of the court.

SECTION 5: Repealing Clause.-

Any provisions of an ordinance inconsistent with the provisions of this ordinance are deemed repealed or null and void.

SECTION 6: Effectivity.- This ordinance shall take effect upon approval.
