AN ORDINANCE DECLARING A PART OF THE MUNICIPAL SEAWATERS WITHIN THE BARANGAY PUNTA CRUZ AS NO FISHING ZONE.

WHEREAS, the government has established an artificial reef within the barangay of Punta Cruz which shall be created as fish refuge and fish sanctuary to ensure self sufficiency among the marginal fishermen within the Municipality in the near future;
WHEREAS, many of our subsistence fisherfolks has been affected by the shrinkage of their catch which was the result of marine exploitation, encroachment of commercial fishers and unsustainable practive some local fishermen;
WHEREAS, the Sangguniang Bayan as the legislative body of the Municipality shall enact ordinances, approved resolutions and appropriate funds for the general welfare of the Municipality and its inhabitants pursuant to Sec. 16 of the Local Government Code of 1991 and wherein which shall also prescribe reasonable limits and restraints on the use of property within the jurisdiction of the Municipality;
NOW ON MOTION, of Hon. Noel D. Veloso, be it ordained by the Sangguniang Bayan in the Municipality of Maribojoc, province of Bohol, that:
SECTION: 1. NO FISHING ZONE.
Includes marine waters between two (2) lines drawn perpendicularly to
the general coastline in the boundary of Barangay Punta Cruz and Guiwanon as well as the boundary of Barangay Punta Cruz and the Municipality of Loon respectively and a third line parallel with the general coastline and Three Hundred (300) meters from it.
SECTION: 2. PROHIBITION.
It shall be unlawful for any person, group of person, cooperative or any
entity to engage in fishing or any means of catching and gathering aquatic products within the declared NO FISHING ZONE of Barnagay Punta Cruz, Maribojoc, Bohol.
SECTION: 3. RESPONSIBILITY OF BARANGAY OFFICIALS
a) It shall be the duty of the Barangay Officials of Punta Cruz to create markers and demarcation lines such as vouys and or any materials circumscribing the restricted area.
b) The Barangay Officials of Punta Cruz shall be deputized to apprehend any entity found in violation to the provisions of this ordinance and shall turn-over the same to the local PNP unit. In all cases of deputized authority, the Barangay Captain shall at all times observe the principle of command responsibility
SECTION: 4. PENALTY
Any violation of the Sections of this Ordinance shall be fined of not less than Five Hundred Pesos (P500.00) and not more than One Thousand Five Hundred Pesos (P1,500.00), confiscation of fish caught and fishing equipment / paraphernalia’s in favor of the government or an imprisonment of not less than Two (2) months but not mpore than Four (4) months at the discretion of the court.
SECTION: 5. EFFECTIVITY.
This Ordinance shall take effect upon approval from the Sangguniang Panlalawigan and publication of the local newspaper.
