FIXING WEDNESDAY OF EVERY WEEK AS REGULAR FUND RAISING DAY THROUGH COCKFIGHTING IN THE MUNICIPALITY OF MARIBOJOC, PROVINCE OF BOHOL.

WHEREAS, Resolution No. 54, series of 1998 as amended, allows the Maribojoc Cockers Circle Management to conduct cockfighting activities every Wednesday at the Maribojoc Cockers Cockpit Arena, San Vicente, Maribojoc, Bohol;

WHEREAS, consistent with the basic policy of Local Autonomy, each local government unit shall exercise its power to create its own sources of revenue subject to the provisions of the Local Government Code of 1991;

WHEREAS, resolutions passed by the Sangguniang Bayan are temporary in nature, it is imperative to amend Res. No. 54-1998 and convert said resolution into an ordinance so that it will be a permanent day of cockfighting activities in the Municipality of Maribojoc, Bohol;

WHEREFORE, be it resolved by the Sangguniang Bayan in their session duly assembled;

BE IT ORDAINED by the Sangguniang Bayan of Maribojoc, Bohol, that:

SECTION 1. The Local Government Code of the Philippines grants local government unit fiscal autonomy to generate its own sources of revenue; hence, it is hereby ordained to fix Wednesday of every week as the regular fund raising day of Maribojoc thru cockfighting.

SECTION 2. The Sangguniang Bayan, being the legislative body of the Municipality of Maribojoc, Bohol, shall regulate cockfighting activities in the locality and such, shall authorize the Local Chief Executive the authority to grant license/permit for the establishment, operation and maintenance of the cockpit, provided that such a grant of authority shall be exercised shall be exercised in conformity with existing laws, promulgations, orders, decrees and other fiats applicable thereof.

SECTION 3. All tickets to be used during cockfighting activities shall be registered in the Municipal Treasurer’s Office and the same shall deputize a representative to oversee the tickets issued during cockfighting;

SECTION 4: The Management of the cockpit shall be obliged to pay all other fees imposed by the municipality per provisions of the existing of the Municipal Tax Code.

SECTION 5: In case of complaints raised by the residents of this municipality, or by any another government agency, a very through investigation shall be conducted and if the complaint(s) is found meritorious enough to warrant action, this ordinance can be amended or repealed or the license may be revoked by the issuing authority.

SECTION 6: Wednesday of every week, being the market day of the municipality, shall be the cockfighting day of Maribojoc, Bohol.

SECTION 7: That this ordinance shall take effect upon approval.
