AN ORDINANCE REGULATING THE USE OF MARIBOJOC MUNICIPAL GOVERNMENT OWNED MOTORCYCLE “YAMAHA” L2-100 CC SN. ENGINE NO. 17V-29156K CHASSIS NO. 17V-029156.

WHEREAS, Republic Act No. 7160, otherwise known as the Local Government Code of 1991, has given Local Government Units, specifically the Sangguniang Bayan greater power and duties as the legislative and policy making body of the Municipality, to enact among others, ordinance for the general welfare of the Municipality and its inhabitants, particularly the proper use and care of Government property.

WHEREAS, it is the prime responsibility of the Maribojoc Municipal Government to send to it that this asset must be abused. However, must be kept always in good order and conditions.

NOW, THEREFORE, be it resolved by the Sangguniang Bayan of Maribojoc, Bohol, that;

Section I: The Yamaha L2-100 cc SN CHASSIS NO. 17V-029156-ENGINE NO. 17V-29156 motorcycle was acquired at the cost of P44,500.00 to be depreciated for so many years as determine by the Commission on Audit.

Section II: This motorcycle is purchased for the sole purpose of utilizing as a mean of transport for collecting water bills and other form of Municipal Government taxes.

Section III: The employee/person in actual physical possession or entrusted with the custody and control of this motorcycle shall be responsible for the proper use and care of the same and shall exercise due diligence in the utilization and safe keeping threof.

Section IV: The employee/person in possession of or having custody or control of the said unit or motorcycle shall be liable for its money value in case if illegal improper or unauthorized use or misapplication thereof, by himself or any other person whose acts he may be responsible and shall be liable for all loss, damage or deterioration occasioned by negligence in the keeping or use of this asset, unless it is proven that he has exercised due diligence and care of utilization and safekeeping thereof.

Section V: Unless he registers his objective in writing, an accountable employee/person shall not be relieved from liability by reason of his having acted under the direction of a superior officer in using this motorcycle for which he is accountable. The officer or department head directing any illegal unauthorized, or improper use of this motorcycle shall first be required to answer therefore.

Section VI: In case of loss, damage or deterioration of this government owned motorcycle, arising from or attributable to negligence in security, the head of the local security unit shall be held liable thereof.

Section VII: This motorcycle shall be driven by a driver who is a holder of unexpired non-prof or professional driver’s license issued by Land Transportation Office. The driver must be authorized by the Municipal Mayor, properly recommended by the Municipal Engineer.

Section VIII: The designated driver of the said motorcycle shall not allow anybody to operate it without the knowledge of the department head, otherwise he shall be liable in case of untoward incident or damage of the property.

Section IX: The use of the motorcycle shall be limited only during office hours and shall not be brought home during weekend by the one who is issued the Memorandum Receipt but shall be deposited in the office of the Municipal Engineer. It can be used after office hours only incase of emergency with the authorization from the Chief Executive Office.

Section X: When the violation committed by any officials or employees of the Municipal Government of Maribojoc, Bohol and other responsible officials thereof who shall have directed or induced the commission of the offense he shall be criminally liable as principal thereof.

Section XI: There shall be a making “FOR OFFICIAL USE ONLY” on both side of the gasoline tank of the motorcycle for proper identification.

Section XII: This ordinance shall take effect upon approval.
