ORDINANCE REQUIRING ALL FISHERFOLKS AND MUNICIPAL FISHER FOLKS TO REGISTER WITH THE LOCAL GOVERNMENT OF MARIBOJOC, BOHOL.

WHEREAS, RA 7160 otherwise known as the Local Government Code of 1991, provides that Local Government Units (LGU) shall have jurisdiction over the municipal waters as provided also in RA 8550, known as Philippine fisheries of 1998;
WHEREAS, the formulation of fishery ordinances is essential in order to prevent exploitation or over use of our marine areas that would eventually cause the depletion of fish catch;
WHEREAS, the registration of fisher folks would result to their own benefits;
NOW THEREFORE, be it resolved by the Sangguniang Bayan of Maribojoc, Bohol that;
Article I
Legal Basis and Purpose
SECTION 1. The Legal basis o f this ordinance R.A. 7160 otherwise known as Local Government code of 1991 and R.A. 8550 known as Philippine Fisheries Code of 1998.
SECTION 2. Purpose.- The ordinance is enacted for the following purposes.
(a) Protect the rights of fisher folks, in the preferential use of the municipal waters. (b) To guide, control and regulate the kind of fishing activities and fishing methods being used. (c) To identify fisher folks engaged in fishing as their means of livelihood and be offered or can avail some assistance at times of crisis in fishing as a result of some legal prohibition.
Article II
Definition of Terms
Fisher folks = people directly or personally engaged in taking and or culturing of aquatic resources.
Municipal Fisher folks= Persons who are directly or indirectly engaged in municipal fishing and other related fishing activities.

Municipal Waters = include not only lakes, inland bodies of water and tidal waters within the municipality which are not included within the protected areas as defined under R.A. 7586 ( N I P A S Law ), public forest, timber lands, forest reserves, but also marine waters included between two lines drawn perpendicular to the general coastline from points where the boundary lines of the municipality touch the sea at low tide and a third line parallel with the general coastline including offshore islands and fifteen kilometers from such coastline.
Article III
General Provisions
SECTION I. All fisher folks / municipal fisher folks not less than 15 years of age must register themselves in the Local Government Unit of Maribojoc, Bohol;
SECTION 2: No person or group of persons shall be allowed to engaged in any fishing activities unless he / she is registered as a municipal fisher folks or as fisher folk.
SECTION 3: A person is considered registered fisher folks or municipal fisher folks of his name is listed in the registry book which shall be maintained at the office of the Municipal Agricultural Officer.
SECTION 4: Barangay Level Registration.- Barangay LGU may accept registration following the same manner of registration provided that said name of the registrant be submitted to the office of the MAO not later than 15 days from date of registration..
SECTION 5: Registration is free and must be doe during the first quarter of every years to expire March 31st of every year.
Article IV
Penal Clause
SECTION 1: Any person / persons violating this ordinance shall be fined with the following:
(a) First offense = P20.00 (b) Second offense = Fine of not less than P 50.00 ( c) Third offense = Fine of P 50.00 or imprisonment of two days or both fine & imprisonment a the discretion of the court
Article V
Effectivity
This ordinance shall take effect upon approval.
