REGULATING THE USE OF CHEMICALS IN SPRAYING THE MANGO TREES IN THE MUNICIPALITY OF MARIBOJOC, BOHOL.

Preliminary Notes
WHEREAS, there are many fruit bearing mango trees in the Municipality of Maribojoc, Bohol;
WHEREAS, mango flowers who spray chemicals on the twigs and leaves of mango trees have no precautionary measures adopted in spraying these chemicals;
WHEREAS, spraying of chemicals in the mango trees affects the health of the people especially those who are residing near the mango trees.
WHEREAS, chemicals being used in spraying the mango trees may cause cancer of the body, thus it is hazardous to the lives of the people;
WHEREAS, in order to protect the lives and health of the people, it is imperative to formulate guidelines for the use of chemicals in spraying mango trees within the jurisdiction of Maribojoc, Bohol;
WHERFORE, be it ordained by the Sangguniang Bayan in their session duly assembled, that:
SECTION 1: Definition of Terms.-
a.) Chemical – a liquid which is a product of a chemical action.
b.) Blower – a person who sprays the chemical to the twigs and leaves of the mango tree.
c.) Spray – water flying in minute drop or small bunch of twig and leaves.
SECTION 2: Registration of Mango Blowers.-
a.) All mango blowers who use to spray chemicals in the mango trees are required to register in the Office of the Mayor and Punong Barangay before conducting the spraying activities of the said mango tree.
b.) Upon registration, a mango blower shall pay a registration fee in the amount of One Hundred pesos (P100.00) per annum at the Municipal Treasurer’s Office and renewable upon expiration of his registration of his being a mango blower.
c.) The Barangay Officials should oversee the spraying activities of the mango blowers.
SECTION 3: Schedule of Spraying.-
To protect the health of the people, there shall be a period of spraying of
mango trees in the following scheme, to wit:
a.) Mango trees in the school sites;
1.) during long summer vacation
b.) Mango trees in the farm without houses in the nearby farmland shall be sprayed anytime of the year provided that precautionary measures will be adopted by the mango blowers.
c.) Mango trees near the residences will be sprayed by chemicals with the agreement of the mango blowers and the residents of the area without the presence of the people for a period of spraying wherein the chemicals will be evaporated on the air.
SECTION 4: Notification and Warning.-
a.) When the mango blowers start their spraying activities, they should notify the people living near the mango trees to be away from the spraying activities in order not inhale the chemicals being used during the spraying.
b.) The mango blowers shall put up placards or signboards near the mango trees notifying the people to be away from the mango trees at least fifty (50) meters radius from the sprayed trees.
c.) Mango blowers shall wear mask to cover their mouth and nose.
SECTION 5: Peanlty.- Any person or group of persons who violates the provisions of this ordinance shall be fined in the amount of P1,000.00 or imprisonment of three (3) days or both at the discretion of the court.
SECTION 6: Repealing Clause.- Any provisions of an existing ordinance which are inconsistent to the provisions of this ordinance shall be deemed repealed and or modified accordingly.
SECTION 7: Effectivity.- This ordinance shall take effect upon approval.
