AN ORDINANCE REQUIRING ALL BARANGAY CAPTAINS IN THE MUNICIPALITY OF MARIBOJOC, BOHOL TO REFLECT THE COMMUNITY TAX CERTIFICATE NUMBER IN EVERY BARANGAY CLEARANCE, PERMIT AND LICENSE ISSUED TO ANY BARANGAY RESIDENT.

WHEREAS, the New Local Government Code of 1991 particularly Section 156 provides that cities or municipalities may levy a community tax effective January 1, 1992;
WHEREAS, it is a standard operating procedures that in any public document issued to a natural or juridical person, the community tax certificate number, the place and the date issued is reflected in such instrument as an evidence that such person is a bonafide resident of certain locality;
WHEREAS, the Barangay Captain, as the Chief of the Barnagay, is empowered to issue clearance or to deny the issuance of the same if a person has previously violated any ordinance or regulation relative to the granting of clearances or permits or failure to pay unsettled tax obligations, debts or liabilities to the barnagay government under any law or regulations;
WHEREFORE, Premised on the following reasons, be it ordained by the Sangguniang Bayan of Maribojoc, Bohol, that:
SECTION 1: A community tax certificate is always exhibited by a person or an entity in the following instances.
a) acknowledging any document before a notary public
b) taking an Oath of Office upon election or appointment to any position in the government service.
c) Receiving any license, certificate or permit from any public authority
d) Paying any tax or fee to the government
e) Receiving any money from any public fund or any salary or wage from any person or corporation
f) Transaction of other official business
SECTION 2: The Barnagay Captain, as the Chief of Office of the Barnagay, has the executive power to issue barnagay clearances, permit and licenses subject to some limitations as set in the Local Code of 1991.
SECTION 3: It shall be obligatory for all Barangay Captains in the municipality to reflect the community tax certificate number in all barnagay clearances, certifications, licenses and permits issued by the Office of the Barangay.
SECTION 4: The reflection of the community tax certificate of any individual or entity is an attestation that the person or persons asking for the issuance of a barangay clearance, certifications, permit or license are of good standing in the community.
SECTION 5: Barnagay Captains may deny the issuance of a barangay clearance in the following instance:
a) previous violation of any ordinance or regulation relative to the granting of clearance or permits.
b) Violation of any zoning, safety and health regulations and other requirements
c) Unsettled tax dues to the barangay government
d) Ineligibility under any provision of law or regulation to establish or operate the business applied for
e) Abuse of privilege to do business or pursue an activity to the injury of public morals and peace
f) When the place of business becomes a nuisance or is allowed to be used by disorderly characters, criminals or women of ill repute.
SECTION 6: Any barangay clearance issued without the community tax certificate number reflected shall not be honored by the municipal government as a prerequisite to securing mayor’s permit.
SECTION 7: Individual below 18 years are exempted in the provisions of this ordinance.
SECTION 8: This ordinance shall take effect upon its approval.
