IMPOSING A RENTAL FEE FOR THE USE OF THE DUMPTRUCK, MULTICAB AND RAMSA SOUND SYSTEM OWNED BY THE LGU-MARIBOJOC, BOHOL, FOR MAINTENANCE PURPOSES.

WHEREAS, the LGU-Maribojoc owns dumptruck, multicab and Ramsa Sound System for the use in the implementation of the different and projects of government;
WHEREAS, these equipment need maintenance for their operation and use;
WHEREAS, there are government agencies and private sectors that would like to avail of the use of these equipment;
WHEREFORE, be it ordained by the Sangguniang Bayan of Maribojoc, Bohol, that:
SECTION 1 : There shall be a fee to be imposed for the use of the following equipment of the LGU-Maribojoc, to wit:
a) For the use of dumptruck (6 wheelers):
i. For government agencies – The rental fee shall be One Hundred Fifty Pesos (P150.00) per hour.
ii. For private sectors – The rental fee shall be Two Hundred Pesos (P200.00) per hour.
The fee shall includes the services of the driver and shall start and end at the Municipal Hall.
b) For the use of multicab:
The rental fee for the use of the multicab shall be One Hundred Fifty Pesos (P150.00) per trip provided the travel will not exceed thirty kilometers. In case the travel exceeds thirty kilometers, the fee shall be One Hundred Fifty Pesos (P150.00) for the first thirty kilometers and an additional of Five Pesos (P5.00) for every kilometer in excess thereof. There fee includes fuel and the services of the driver and shall start and end at the Municipal Hall.
c) For the use of Ramsa Sound System:
The rental fee for the use of the Ramsa Sound System shall be One Thousand Five Hundred Pesos (P1,500.00) per day. In case the use exceeds one day, the rental fee for the succeeding days shall be One Thousand Pesos (P1,000.00) per day. The fee includes the services of the operator.
SECTION 2 : The Municipal Mayor and the Municipal Engineer shall be the exclusive persons to decide the use of the above-mentioned equipment.
SECTION 3 : Any person or entity who shall avail of the use of the dumptruck, multicab, or Ramsa Sound System shall see first either the Office of the Mayor or the Office of the Municipal Engineer.
SECTION 4 : Payments shall be made at the Office of the Municipal Treasurer before the use of the above-mentioned equipment.
SECTION 5 : The use of the above-mentioned equipment shall be available only during working days and working hours except for the use of the Ramsa Sound System which sometimes requires non-working days and off hours.
SECTION 6 : When the Ramsa Sound System is in use during off hours or non-
working days, the operator shall be given an overtime pay equivalent to the regular working day compensation of a casual employee.
SECTION 7 : It shall be the duty of the person or entity who avail of the use of the Ramsa Sound System to provide free snacks and meals to the operator.
SECTION 8 : The above-mentioned equipment shall not be used privately by any municipal officials or employees without first seeking the approval from the Municipal Mayor or Municipal Engineer and paying the required fee thereof.
SECTION 9 : It shall be the duty of the office of the Municipal Engineer to adopt measures and methodologies for the implementation of this ordinance.
SECTION 10 : Any municipal official or employee, regular or casual, who is found to have violated any of the provisions mentioned in this ordinance shall be charged administratively by the office of the Sangguniang Bayan.
SECTION 11 : This ordinance shall take effect upon its approval.
