AN ORDINANCE DELINEATING THE BOUNDARIES OF THE MUNICIPAL WATERS OF THE MUNICIPALITY OF MARIBOJOC, PROVINCE OF BOHOL.

BE it ordained by the Sangguniang Bayan of Maribojoc, Bohol, that:
SECTION 1. This ordinance shall be known as Municipal Waters Boundary Delineation of the Municipality of Maribojoc, Province of Bohol.
SECTION 2. Declaration of Policy.- It is hereby declared the policy of the Municipality to:
1. Protect and manage the municipal waters and its coastal and fisheries resources for the employment and benefits of the municipal fishers.
2. Manage the coastal and fishery resources of the municipality, in a manner consistent with the principle of coastal resource management; and
3. Enhance people’s participation in the management of the municipal waters and its coastal and fishery resources.
SECTION 3: Definition of Terms.- As used in the ordinance, the following will mean as follows.
Municipal Waters – include not only streams, lakes, inland bodies of water and tidal waters within the municipality which are not the subject of private ownership and not included within the national parks, brackish water fishponds leased by the government, and national fishery reserves, refuge and sanctuaries but also marine waters included between two lines drawn perpendicular to the general coastline from points where the boundary lanes of the municipality touch the sea at low tide and a third 1 line parallel with the general coastline including offshore islands and 15 kilometers from such coastline. Where two municipalities are so situated opposite shores such that there is less than thirty (30) kilometers of marine waters between them, the third line shall be a line equidistant from the opposite shores of the respective municipalities.
SECTION 4: Boundaries of the Municipal Waters.- Pursuant to the provisions of the Local Government Code of 1991 the Philippine Fisheries Code of 1998, and upon the validation and recommendation by the National Mapping and Resource Information Authority, it is hereby delineated as shown in the NAMRIA Map No. MW-NGW-oi9, series of 2002, the technical description of the Municipal waters of the Municipality of Maribojoc, Province of Bohol are bounded by the general coastline of the municipality and the lines described as follows:

The Municipal waters boundaries are delineated for the purposes of determining the geographic extent of the municipality’s taxation or revenue generation powers, its enforcement justification resources allocations, and general management powers.
SECTION 5: Repealing Clause.- All previous Ordinances and Resolutions or part thereof which are inconsistent with this ordinance are hereby repealed and modified accordingly.
SECTION 6: Separability Clause.- If for any reason or reasons, any part or provisions of this ordinance shall be held unconstitutional or invalid, other parts or provisions hereof of which are not affected thereby shall continue to be in full force and in effect.
SECTION 7: Effectivity Clause.- This ordinance shall take effect ten (10) days after a copy of the ordinance or posted in a bulleting at the entrance and in at least two(2) other conspicuous places of the municipal building or the ordinance has been published once in a local newspaper of general circulation in the municipality.
