IMPOSING A ZONING / LOCATIONAL CLEARANCE FEE IN THE MUNICIPALITY OF MARIBOJOC, BOHOL.

Preliminary Notes

WHEREAS, the Zoning / Locational Clearance fee was collected by the National Government through the Office of the HLURB Office in Region VII, Cebu City;

WHEREAS, it is imperative to adopt a Local Ordinance to collect such fee in the municipality since the power to impose is devolved to the Local Government from the HLURB;

WHEREAS, considering the aforecited reasons, the Sangguniang Bayan of Maribojoc, Bohol in their session duly assembled hereby adopts this ordinance;

WHEREFORE be it resolved by the Sangguniang Bayan in their session duly assembled;

BE IT ORDAINED by the Sangguniang Bayan of Maribojoc, Bohol, that:

SECTION 1: There is hereby imposed a Zoning / Locational Clearance fee in the Municipality of Maribojoc, Bohol;

SECTION 2: Hereunder are the following Zoning / Locational Clearance fee schedules, to wit:

A. single residential structure attached or detached Fee

1. P100,000 and below – P200.00
2. Over P100,000 to P200,000- P400.00
3. Over P200,00 – P500 + 1/10 of 1% in excess of P200,000.00

B. Apartments / Townhouses

1. P500,000 and below – P1,000.00
2. Over P500,000 to 2 million – P1,500.00
3. Over 2 million – P2,500+1/10 of 1% of cost in excess of P2 Million regardless of the number of door

C. Dormitories

1. P2 Million and below – P2,500.00
2. Over P2 Million – P2,500+1/10 of 1% of cost in excess of P2Million regardless of the number of doors

D. Institutional Project cost of which is

1. Below of P2 Million – P2,000.00
2. Over P2 Million – P2 Million+ 1/10 of cost in excess of P2 Million

E. Commercial, Industrial and Agro-Industrial Project Cost of which is (poultry, piggery)

1. Below P100,000.00 – P1,000.00
2. Over P100,000 – P500,000.00 – P1,500.00
3. Over P500,000 – P1 Million – P2,000.00
4. Over P1 M – P2M – P3,000.00
5. Over P2 Million – P5,000+1/10 of 1% of cost in excess of P2 Million

F. Special Uses/Special Projects
(Gasoline station, cell sites, beach resorts, slaughterhouse treatment plant etc.)

1. Below 2 Million – P5,000.00
2. Over P2 Million – P5,000+1/10 of 1 % of cost in excess of P2 Million

G. Alteration/Expansion (affected areas/cost only – same as original applications

SECTION 3: Penalty.- person or group of persons who violates the provisions of this ordinance shall be fined of P2,000.00 or an imprisonment of not less than 10 days or both at the discretion of the court.

SECTION 4: Effectivity.- This ordinance shall take effect upon approval.
