AN ORDINANCE REQUIRING PRIVATE WELL DRILLERS CONTRACTORS TO SECURE MAYOR’S PERMIT BEFORE DRILLING AND EXCAVATION OF THE GROUND FOR LYING THE WATER.

WHEREAS, the Local Government Code of 1991, particularly section 447, paragraph VIII provides that Sangguniang Bayan shall regulate the drilling and excavation to promote the general welfare and ensure the public safety;
WHEREAS, private well drillers are hired by residents of the Municipality for the purpose of locating and lying of potable water for private use;
WHEREAS, these private well drillers are practicing their profession in the Municipality casually and the derived big profit while the Municipality will deprived of its revenues;
WHEREFORE, be it ordained by the Sangguniang Bayan in its assembled session that:
Sec.1- Any private well driller hired to drill for the purpose of lying water shall see first the office of the Mayor to secure Mayor’s Permit for him to operate in the Municipality.
Sec.2- The private well driller shall pay the amount of One Hundred Fifty (P150.00) AS Mayor’s Permit Fee for every drilling.
Sec.3- Requirement before the issuance of Mayor’s Permit, a barangay clearance and sanitary permit shall be presented to the Mayor incase the drilling is located in any of the Barangay of the Municipality.
Sec.4- It shall be the duty of the barangay officials to report to the local chief executive any drilling and excavation conducted in their respective barangay for the purpose of lying water and other pipes;
Sec.5- The owner of the newly installed well shall coordinate with the municipal health inspector to check whether the water is fit for human consumption.
Sec.6- Local drillers should be exempted from permit fee but required to secure the Sanitary and Mayor’s Permit.
Sec.7- The contracting party shall inform the private well driller of the municipal ordinance governing the drilling of well within the locality.
Sec.8- Any private well driller who drills and excavates the ground of any private land for lying of water without prior approval and procurement of mayors permit shall be fined of not more than two thousand five hundred pesos and imprisonment of not more than six months or both as the discretion of the court.
Sec.9- This ordinance shall take effect upon its approval.
