AN ORDINANCE REGULATING WITHIN THE MUNICIPALITY OF MARIBOJOC, BOHOL.

WHEREAS, the Sangguniang Bayan shall enacts measures to protects the inhabitants of the Municipality from harmful effects of bad practices of man;
WHEREAS, medical and scientific studies pointed out smoking to be the major contributing factor in acquiring respiratory, throat and lung diseases, and does not only affects smokers themselves, but also those who are around who can inhale the smoke, not giving exemptions to the unborn children in their mother’s womb;
WHEREAS, it is one of the programs of the Department of Health, headed by6 Secretary Juan Flavier, to discourage Filipinos to continue smoking;
WHEREAS, radio and TV plugging and write-ups are heard and read to educate the smokers, yet, smokers remain blind and deaf to the cry to stop smoking;
WHEREAS, it is deemed necessary for legislators to do our part in this drive by enacting Ordinances to assist the Department of Health in this “STOP SMOKING “program;
WHEREFORE, be it ordained by the Sangguniang Bayan of Maribojoc, Bohol to regulate smoking within specified ares;
Sec.1- It will be unlawful to any person caught smoking in specified areas, such as:
1. Municipal Hall, ABC Hall, Barangay Hall and other Municipal Government Offices
2. Vehicles ( Public Utility and Privately owned ) within the jurisdiction of the Municipality of Maribojoc, Bohol.
3. Eatery Sections at the Public Market and other Restaurants
4. Church premises and School Campuses
Sec.2- It will be unlawful for any person caught smoking during public assemblies and meetings.
Sec.3- It will be unlawful for minors ( below 18 years of age ) caught smoking within the Municipality of Maribojoc, Bohol.
Sec.4- Persons in authority at areas specified in Section1, shall provide specified rea for smoking in their respective jurisdiction
Sec.5- “NO SMOPKING” signs shall be posted at areas specified in Section1.
Sec.6- Penalty clause:
1st offense P100.00 fine
2nd offense P250.00 fine
3rd offense P500.00 fine and one day imprisonment
Sec.7- Penalties be imposed also to vehicle driver or operator and to operators of carenderias who allow smoking in their respective jurisdiction.
Sec.8- This ordinance shall take effect upon approval.
Let copies be furnished to Barangay Captains, School Principals, Parish Priest for information and guidance.
