AN ORDINANCE BANNING THE OPERATION OF ELECTRIC SHINNERS IN THE MUNICIPAL WATERS OF THE MUNICIPALITY OF MARIBOJOC, BOHOL.

Be it ordained by the Sangguniang Bayan of the Municipality of Maribojoc, Province of Bohol, that:
Section 1- Definition of terms – when used in this ordinance, the following terms shall be construed to mean.
a.) Municipal Waters – include not only streams, rivers, lakes and tidal waters within the Municipality, not being the subject of private ownership and not comprised within the national parks, public forests, timberlands, forest reserves, or fishery reserves, but also marine waters included between (2) two line drawn perpendicularly to the general coastline from points where the boundary lines of the Municipality touch the sea at low tide and a third line parallel with the general coastline and (15) fifteen kilometers from it. Where two (2) Municipalities are so situated on the opposite shores that there is less than fifteen (15) kilometers of marine waters between them, the third line shall be equally distant from opposite shores of the respective municipalities. Refer Sec.131 (r) of R.A. No. 7160.
b.) Fishing Boat – refer to all boats, such as bancas, sailboats, motorboats or any type of waterfcrafts, whether licensed or not, used for fishing purposes.
c.) Electric Shinners – refers to the fishing methods which uses a fishing boat, an electric generator and high-wattage bulbs locally known as “Electric Shinners” which provides illumination and strong or a sporadic light in order to attract and lure fishes of all types.
Section 2- Prohibition – it shall be unlawful for any person or group of person to operate fishing boats of whatever tonnage to engage in fishery in the Municipal Waters of the Municipality of Maribojoc, Province of Bohol with the use of electric shiners and other similar methods with the use of electricity.
Section 3- Penalty – violation of this ordinance shall subject the offender to a penalty of a fine of One Thousand Pesos (P1,000.00) pesos to Two Thousand Five Hundred (P2,500.00) pesos or imprisonment of two months and one (1) day to six (6) months or both such fine and imprisonment at the discretion of the court and confiscation of the fishing gears, fishing boat, fishing equipment / paraphernalia. Provided further that all the proceeds of the crime and all instruments and tools confiscated and forfeited in favor of the Government shall be turned over of the Muncipality of Maribojoc, Bohol.
Section 4- Repealing Clause – Any ordinance or sections and subsections of an ordinance which are inconsistent to the provisions of this Ordinance are hereby repealed and / or amended accordingly.
Section 5- Effectivity Clause – This ordinance shall take effect upon approval.
