REQUESTING THE REGIONAL EXECUTIVE DIRECTOR OF THE DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES, REGION VII, CEBU CITY THRU THE PROVINCIAL ENVIRONMENT AND NATURAL RESOURCES OFFICE (PENRO) TO HOLD IN ABEYANCE THE APPROVAL OF THE LAND TITLES APPLIED BY LAND CLAIMANTS FROM MARIBOJOC, BOHOL WITHOUT THE OFFICIAL RECEIPT ISSUED BY THE CADASTRAL SURVEY CONTRACTORS / SURVEYOR, ENGR. ANTONIO L, DOMINGUEZ AND ENGR. GIL D. DOMINGUEZ AS PROOF OF FULL PAYMENT OF THE CADASTRAL SURVEY OF THE SAID LOTS.

WHEREAS, the Cadastral Survey of the lands in the Municipality of Maribojoc, Bohol is undertaken by private Cadastral Contractors / Surveyors, Engr. Antonio L. Dominguez and Engr. Gil D. Dominguez of Tagbilaran City;

WHEREAS, the Cadastral Survey of Maribojoc, Bohol was started in the year 2004 and at present the Cadastral Survey returns of Anislag and Punsod, Maribojoc, Bohol are approved by the Regional Office of the Department of Environment and Natural Resources, Cebu City;

WHEREAS, many land owners in the barangays being surveyed by the private contractors have not fully paid their cadastral fees as stipulated in the contract signed by the LGU-Maribojoc and the Dominguez Surveying firm of Tagbilaran City;

WHEREAS, it is to the disadvantage of the Cadastral Survey Contractors if the Cadastral Survey return of the lot owners will be approved without paying the full amount of the cadastral fee as the lot owners obligations to the survey Contractor;

WHEREAS, in fairness to the Survey Contractors, the survey returns of the surveyed lots should be held in abeyance pending their full payment of the services rendered by the contractors;

WHEREFORE, BE IT RESOLVED, by the Sangguniang Bayan in their session duly assembled;

“To request the Regional Executive Director of the DENR, Regional VII, Cebu City thru the PENRO, Tagbilaran City to hold in abeyance the approval of the land titles applied by land claimants form Maribojoc, Bohol without the official receipt issued by the Cadastral Survey Contractors/Surveyors, Engr. Antonio L. Dominguez and Engr. Gil D. Dominguez as proof of full payment of the Cadastral Survey of the said lots”;

BE IT RESOLVED FURTHER, that copies of this resolution be furnished, the Regional Executive Director, DENR, Region VII, Cebu City, PENRO, DENR, Tagbilaran City an dEngr. Anotnio L. Dominguez and Engr. Gil Dominguez, Tagbilaran City for their appropriate action and kind consideration.
